Defense “Alex W. is not fully responsible”
After the expert witness was released it is the defense who came up with the closing arguments. The court assigned defense counsel started by contemplating about the rule of law and how justice can be served. He highlightened the need to focus on the legal issue “heat of the moment”. He posted 4 motions which will provide further evidence that Alex W. is not fully responsible for the crime he committed. Motion # 1 asks for a psychological test to prove that the defendant was under a mental disorder when the crime was done. Motion # 2 asks for another psychiatric expert to present a 2nd opinion proving that reduced sentencing has to be the only legal consequence. Motion # 3 asks for further witness testimony to prove that the defendant suffered occasionelly by certain mental disorders. Motion # 4 asks for an expert witness who will testify that the defendant showed symptoms of paranoid patterns of behavior which will lead to the medical conclusion that he has a mental disorder (i.e. paranoid schizophrenia). At 19.40 h the defense counsel pleaded only for homicide and therefor not life but a sentencing within the discretion of the court (i.e. max. 15 years).
The defendants 2nd counsel also concentrated on the issue of the “heat of the moment” and critized the expert opinon on Alex W. which resulted in full responsibility.
The public and the private prosecutors demanded to dismiss defenfant’s motion.
